SMS and Email Terms and Conditions
By checking the box, you expressly consent to receive non-marketing and marketing text messages and emails from PT Peak Fitness and others texting on its behalf, including text messages made with an autodialer, at the telephone number(s) that you provide. You may opt-out of these communications at any time, and consent to receive marketing text messages and emails are not required to purchase any goods or services.
You also accept and agree to be bound by these SMS Terms and Conditions, the Website Terms of Us, our Privacy Policy, and any other applicable terms and agreements related to your use of PT Peak Fitness service.
PT PEAK FITNESS MEMBERSHIP TERMS AND CONDITIONS
- This agreement is between PT PEAK Fitness Pty Ltd and the member (you). Please read, understand, and follow all terms and conditions. Studio policies apply to all members and casual visitors.
- Age Restrictions: All memberships are only available for ages 16+.
- Visitors under 16 years of age are not allowed to enter PT PEAK Fitness premises when no PT PEAK staff are present.
- Membership & Payment: Your membership and payments begin upon signing or purchase via the PT PEAK Fitness website or Member Glofox app. Memberships are personal and non-transferable. However, if you need to transfer your membership, a joining & Key setup fee of $94 will apply.
- Digital Key Access Policy: Your Digital Key is strictly for your individual use only and is non-transferable under all circumstances. You must not share, lend, or allow any other person or people to use your digital key or enter the premises using your access. Any member found sharing their key, unlocking the studio door for a non-member, or providing access to a non-member will be subject to the following, without exception: a) A $150 penalty (non-negotiable and payable in full), b) Immediate suspension of access for 4 weeks, or termination of membership. The requirement to pay any outstanding membership fees in full, including remaining contract obligations. c). No refunds will be issued for any unused membership time, remaining credits, or prepaid service packages if the membership is suspended or terminated due to breach. No cancellations or terminations can be processed until the fine is fully paid. If the $150 penalty is not paid, the matter will be transferred to a debt collection agency, and a formal report will be filed with NSW Police for trespassing, PT PEAK Fitness reserves the right to use digital access logs, CCTV footage, and other system records to verify breaches. This policy exists to protect all members and the integrity of our secure access system. All members must leave the premise by 9:30 pm (Mon–Sat) or 7 pm (Sun/Public Holidays). Failure to follow this policy will result in membership suspension for 4 weeks without refund.
- Upgrading/Downgrading: Upgrades are free; downgrades require settling current fees. A cancellation fee of $150 applies for early termination. 21 days’ email notification is required. No refund will be provided.
- Upfront Memberships & Casual Passes: Must be paid in full upon purchase and are non-refundable. Cancellation is required if it is a recurring payment membership.
- Cancellation: To cancel your membership, provide an email written notice 21 days in advance. Your membership and recurring payments will STOP only when we receive your cancellation application form and the full payment of the cancellation fee (if required) or any outstanding fee. Cancellation fees will apply if you cancel within the minimum agreement period.
- Termination by PT PEAK Fitness: We may terminate your membership if: (a) You breach these Terms and Conditions or Studio Policies. (b) We can refuse/block your entry to PT PEAK Fitness premises and cancel/terminate your membership for inappropriate, threatening, or harassing behaviour, damaging equipment or facilities, intoxication, or use of illegal drugs or discrimination within PT PEAK Fitness premises. No refunds or credits will be issued.
- Collection of Fees: If your membership is terminated for any of these reasons, we may recover any outstanding membership fees and reasonable costs and expenses we incur as a result of your breach, including debt recovery expenses and legal costs.
- Membership Pausing Policy – General Conditions (All Memberships)
- All pause requests must be submitted in writing at least 21 days prior to the intended pause start date.
- Written notification must be emailed to info@ptpeakfitness.com.au and accompanied by a completed Pause Membership Form.
- Membership fees must be up to date at the time of request.
- No backdated or same-day pause requests will be approved, unless due to urgent or medical circumstances, with supporting documentation.
- Membership access is suspended during an approved pause period.
- PT PEAK Fitness reserves the right to approve or refuse pause requests at its discretion.
- Pause limits reset only upon commencement of a new paid membership agreement.
- 11.1 Pause with No Lock-In / Month-to-Month/ Group Fitness Memberships:
- Members may pause their membership for a maximum of 28 days per calendar year.
- Recurring payments will automatically resume after the nominated pause end date or after 28 days, whichever occurs first.
- A minimum of 21 days’ written notice (email + Pause Membership Form) is required prior to the next billing date.
11.2 Pause with Fixed-Term Studio Memberships (6 or 12-Month Agreements)
- Pause requests are limited to a maximum of 8 weeks per membership agreement.
- Approved pause periods will be added to the end of the current membership term.
- All pause requests must be submitted via email with a completed Pause Membership Form.
- A minimum of 21 days’ written notice is required prior to the next billing date.
11.3 Pause with Memberships at Foundation Member & Upfront Discount Rates – This section applies to studio memberships held at discounted rates, including:
- Weekly membership fees below $14.99 per week
- 6-month upfront memberships below $399
- 12-month upfront memberships below $599
11.3(a) With Medical or Unforeseen & Uncontrollable Circumstances:
- Pauses are permitted only for medical reasons or unforeseen and uncontrollable circumstances, with supporting documentation.
- Maximum pause period: 8 weeks per membership agreement.
- Unforeseen and uncontrollable circumstances do not include holidays, travel, personal schedule changes, or convenience-based requests.
11.3(b) With Non-Medical Pause Requests:
- If a pause is requested for non-medical reasons, a pause may be approved for a maximum of 6 weeks.
- A $49 reactivation/setup fee applies and must be paid prior to access being reinstated.
11.4 Cancellation & Rejoining:
- Members may choose to cancel and rejoin at a later date instead of Pause the membership.
- Rejoining must be at current membership pricing.
- Standard joining and digital key setup fees will apply.
- Previous discounted or foundation rates are not available upon rejoining.
- Termination after 6 or 12 Months Membership (Including Upfront Payment Membership): 21 days’ written notification via email is required. Notifications sent shorter than 21 days will not be refunded. Rejoining or signing up after cancellation will incur joining fees and the new rate.
- Account/Payment Method: Please check your account details before purchasing a membership. If payments are outstanding, we will continue debiting your account without notice. A $10 dishonor fee applies to failed payments. PT PEAK Fitness reserves the right to transfer accounts with unpaid fees to a debt collection agency.
- Group Fitness: Class credits are issued every fortnight and do not roll over. Cancellations must be made 2 hours prior to the class, or credits will not be refunded. Group fitness and PT session bookings are compulsory.
- Late Cancellations or No Shows for group training & PT sessions: The credit will not be refunded or restored.
- Personal Training Appointments and Cancellation Policy: Personal training packages, credits, or services are non-refundable once purchased or once expired. No exceptions will be made for change of mind, schedule conflicts, or lack of use. However, if a valid medical certificate is provided, the package/credit may be extended for up to 2 months from the original expiry date, or transferred to another nominated person. Extensions or transfers must be requested before the package expires and must be submitted in writing. PT PEAK Fitness reserves the right to decline requests that fall outside these conditions or lack sufficient documentation. All personal training sessions must be booked in advance. Late cancellations or no-shows will result in the session credit being forfeited in line with our standard cancellation policy.
17. Responsibility for Damage: You are responsible for any damage you cause to PT PEAK Fitness facilities, services, products, or equipment due to willful acts or negligence.
18. Health & Safety: Exercise at your own risk and disclose any health issues. PT PEAK Fitness is not liable for injuries resulting from undisclosed conditions. PT PEAK Fitness reserves the right to refuse entry or terminate memberships based on health reasons for the safety of members.
19. Facility Use: Follow cleanliness, attire, and equipment rules. Lockers are provided, but PT PEAK Fitness is not responsible for lost items. (a) Towels and Cleanliness: Towels should be used when exercising on gym equipment to maintain hygiene. All used equipment, mats, and attachments must be wiped down after use. (b) Gym Floor: Weights, benches, boxes, and attachments must be put away correctly after use. (c) No Food or Drinks: Besides water, no food or drinks are allowed in the equipment/facilities area. (d) Modifications: PT PEAK Fitness reserves the right to modify facilities, equipment, schedules, or terms as necessary.
20. Personal Information: Please promptly update us on any changes to your address, contact details, or payment information. You can also log in via the PT PEAK Fitness website or Glofox app to update your details.
21. Privacy: We collect and use your personal information to provide services and manage your membership as per our Privacy Policy. No hard copies of bank or credit card details are kept on the premises.
22.Governing Law: These Terms and Conditions are governed by the laws applicable in your state or territory.
23. Cooling-Off Period and Cancellation Policy: You may cancel your membership within 48 hours of signing up, without incurring a cancellation fee $150. A written cancellation form must be submitted within this timeframe. The first membership payment is non-refundable. The Joining Fee and Digital Key Setup Fee are strictly non-refundable, regardless of cancellation timing. After the initial 48-hour period, our 21-day cancellation policy will apply. You must provide 21 days’ written notice and submit and cancellation form to cancel your membership. During this time, regular payments will continue, and your membership will remain active until the end of the 21-day notice period.
24. Changes to Terms: We may change our Terms and Conditions, pricing, fees, timetables, or rules at any time without notice. By continuing to use PT PEAK Fitness, you agree to the updated terms
25. Security Surveillance: PT PEAK Fitness uses CCTV for security purposes, except in bathrooms. This does not guarantee against harm.
26. Acknowledgement & Agreement: By signing up to PT PEAK Fitness, you acknowledge that you have read, understood, and agreed to all the above Terms and Conditions and Studio Policies. By ticking the box during signup or signing this agreement in person, you give full consent to be bound by these terms.
